NOTES FOR DEEDS REGISTRATION
1. The Acknowledgement Slip issued by the Lands Commission does not constitute the registration of Deed submitted for registration.
2. Deed registration is dealt with in accordance with Chapter six of the Land Act, 2020 (Act 1036), a function of the Land Registration Division of the Lands Commission.
3. All transactions on Public/State Lands must first be handled by the Public and Vested Lands Management Division (PVLMD) of the Lands Commission which is legally mandated under Section 23 of Lands Commission Act, 2008 (Act 767) to manage public lands and all lands vested in the President.
4. All stool land transactions are also constitutionally required to be certified by the Regional Lands Commission of the Region where the lands are situate before submission to the Land Registration Division.
5. A deed or an instrument submitted for registration shall have priority, according to the order in which it is presented to the Lands Commission.
6. Registration under the Act 1036 is compulsory for all land owners and penalties are payable by persons who fail to register their instrument.
7. Final judgments of Courts of competent jurisdiction are also to be registered.
8. Application for Deeds registration of land should be submitted by the owner/representative at the Client Service Access Unit (CSAU) of the Lands Commission in their respective Regions.
9. No pillar erected at the corner points on a registered parcel of land should be moved or disturbed. It is an offence to remove or disturb any such pillar whether it is erected on your own land or not. It is also a criminal offence punishable by a fine or imprisonment or both to enter upon any land without lawful authority and willfully destroy fences and/or buildings erected thereon.
10. Further information in relation to compulsory land registration may be obtained from the CSAU.
11. Any person who seeks to object to an application as listed above is required to provide the basis and justification for the objection and should attach copies of all supporting documents such as; Court judgments, Wills, Letters of Administration and Court proceedings to an objection letter to the CSAU of the Regional Offices for resolution.
12. If item 11 is not complied with, the objection will not be accepted.
